Terms of use - prohibited conduct
Acceptable Use Policy
Last updated: 2026-05-28
Draft - pending counsel review before launch.
This Acceptable Use Policy (AUP) supplements our Terms of Service. Violations may result in account suspension without prior notice.
Spam and unsolicited messaging
Sending unsolicited promotional messages, bulk email, or SMS campaigns without documented opt-in consent from recipients is prohibited. You are responsible for CAN-SPAM, TCPA, and GDPR compliance for every communication you send using our output.
Malware, phishing, harmful code
You may not distribute malware, ransomware, trojans, or phishing material through our service - including in attachments, links, or generated ad copy.
Scraping and automated access
Automated scraping of our app surface, reverse-engineering the API beyond officially documented endpoints, or circumventing rate limits is prohibited.
IP infringement
Uploading content that infringes copyright, trademarks, trade secrets, or other intellectual property rights of third parties is not permitted. DMCA notice-and-takedown is honoured.
Harassment, hate speech, illegal content
Content that harasses, threatens, or demeans people based on protected characteristics is prohibited. So is content illegal in your jurisdiction or the jurisdiction of your audience.
Security testing
Penetration testing, load testing, or vulnerability scans against our infrastructure require prior written authorisation. Responsible disclosure of vulnerabilities is rewarded - see security.txt.
Reverse engineering
Decompiling, disassembling, producing derivative works of our software, or making source code accessible is prohibited unless expressly permitted.
Resale and re-branding
You may not resell Trailmaker output unmodified as your own service or tool. Using generated outputs for your own brand campaigns is explicitly allowed - that's the point.
Fair use of AI generations
Pro-plan limits assume human usage. Automated API loops that exhaust our AI generation capacity beyond reasonable use qualify as abuse and may lead to throttling or suspension.
Enforcement
On suspected violation we may temporarily suspend your account (investigation), remove content, or terminate permanently. Serious violations are reported to the relevant authorities.
Report violations
Report violations to abuse@trailmaker.app - include the URL/account reference, type of violation, and screenshots if applicable. We respond within 5 business days.
